San Antonio Social Security Child Disability Lawyer
Being the parent of a disabled child is tough. There are more concerns and issues for the parent has to deal with then if the child were not disabled. They may need special education and more personal, intensive care at home. This costs money, and the financial burden it places on families can be overwhelming. Fortunately, Social Security Disability Insurance (SSDI) does exist for children. At the law office of Michael F. Archer, P.C., we have extensive experience working with disabled children and their families on their disability claims to make sure they receive the Social Security Disability benefits they deserve.
How does a child qualify for SSDI?
The definition of a disability for a child differs from that of an adult. In order for a child to be eligible for disability they must meet all three of the following criteria:
have a physical or mental impairment, or combination of impairments
the impairment must severely limit the child's functionality
the impairment must have lasted, or be expected to last, for a minimum of one year, or lead to death
Once a medical impairment has been established by appropriate medical personnel, the Social Security Administration looks at six listed domains to show the severity of the impairment and how it has affected the child. These listed domains are:
Acquiring and using information
Attending to and completing tasks
Interacting and relating with others
Moving about and manipulation of objects
Caring for self
Health and physical well being
The Social Security Administration will then consider all of the information regarding the child's disability in determining whether the child is eligible for benefits. Our SSDI attorney assists families in gathering the necessary information needed to establish the child's disability. We also determine if the client meets the income level requirements established by the government.
