Qualifying for Social Security Disability
One of the biggest concerns our clients typically have when they come into our office is if they will be able to meet the disability requirements mandated by the Social Security Administration. Social Security Disability benefits are given to working citizens of the United States who are injured and can no longer work. Work-length requirements will depend on what age the person was when the disability occurred. Typically, individuals must obtain forty work credits and twenty (approximately five years' worth) of those must be earned in the ten year period before the injury occurred. If a person is not eligible for Social Security Disability Insurance (SSDI), there is a chance they might qualify for Supplemental Security Income (SSI).
To qualify as being disabled a person must have:
worked in jobs that Social Security covers
an injury which meets the Social Security Administration's definition of disability
a disability that is expected to last for a minimum of year or lead to death
To determine if a claimant is disabled, Social Security Administration looks at five things:
Employment status
Severity of the injury
Capability of the person to do the same work they were doing before the injury
Age, education, and work experience, the capability of the injured party to do another type of work
